Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules governing your use of the ServiceSmartOS platform. It is incorporated into and forms part of the Terms of Service.

ServiceSmartOS is an AI-powered contractor operating system designed for asbestos, demolition, remediation, civil, construction and trade service businesses. It is designed to be used for legitimate business purposes consistent with that context. Any use of the platform that falls outside these boundaries is prohibited.

We reserve the right to immediately suspend or terminate accounts that violate this policy without notice, and to report serious violations to relevant law enforcement or regulatory authorities.

2. Prohibited Conduct

2.1 Illegal Activities

You must not use ServiceSmartOS for any purpose that is unlawful or that violates any applicable laws or regulations in Australia, New Zealand, or any other jurisdiction in which you operate. This includes, but is not limited to:

  • Creating fraudulent or falsified safety documentation, including backdated or fabricated SWMS, incident reports, or competency records
  • Using the platform to conceal, minimise, or misrepresent workplace accidents, near misses, or non-compliance with health and safety obligations
  • Uploading, storing, or transmitting content that infringes copyright, trade marks, patents, or other intellectual property rights
  • Engaging in activities that violate the New Zealand Health and Safety at Work Act 2015, the Australian Work Health and Safety Act 2011 (Commonwealth) or equivalent state or territory legislation

2.2 System Security and Integrity

You must not:

  • Attempt to gain unauthorised access to any part of the platform, its underlying systems, other users' accounts, or data
  • Upload or transmit any malware, ransomware, spyware, viruses, Trojan horses, worms, or other malicious code
  • Conduct penetration testing, vulnerability scanning, or security research against the platform without prior written authorisation from ServiceSmartOS
  • Interfere with or disrupt the platform, its servers, or networks connected to it, including through denial-of-service attacks or similar techniques
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the platform
  • Use automated tools, bots, or scripts to access, scrape, or extract data from the platform at a rate that adversely impacts system performance for other users
  • Bypass or circumvent any access controls, authentication mechanisms, or security features of the platform

2.3 Misuse of AI Features

The AI content generation features of ServiceSmartOS are provided to assist in drafting operational, compliance, safety, environmental and business documentation. You must not:

  • Use AI-generated content without review and validation by a competent person, and present it as having been independently prepared
  • Attempt to use AI features to generate content that is designed to deceive regulators, auditors, or inspectors
  • Attempt to manipulate AI outputs through prompt injection, adversarial inputs, or other techniques designed to produce harmful or misleading content
  • Use AI generation features to produce content unrelated to legitimate business operations on the platform
  • Submit false or misleading input context to AI generation features with the intent of generating inaccurate or fabricated documentation

2.4 Inappropriate Content

You must not upload, create, store, or transmit content through ServiceSmartOS that:

  • Is defamatory, obscene, offensive, or harassing towards any individual or group
  • Constitutes or facilitates harassment, bullying, or discrimination on the basis of any protected characteristic
  • Contains personal information about individuals that you are not authorised to process or store
  • Violates any applicable privacy law, including by uploading sensitive personal information (such as health data, financial information, or identification documents) outside the intended purpose of the platform

2.5 Account and Access Misuse

You must not:

  • Share your account credentials with individuals who are not authorised users of your subscription
  • Create multiple accounts to circumvent the trial period limit, account suspensions, or pricing tiers
  • Impersonate ServiceSmartOS, its employees, or other users
  • Use the platform in any way that places an unreasonable or disproportionate load on our infrastructure

3. Responsible Use of Platform Records

ServiceSmartOS is used to create and manage legally significant operational, compliance, safety and workforce records. By using the platform, you acknowledge that:

  • Safety documentation created using this platform must accurately reflect the actual work conditions, hazards, and controls applicable to each specific project or worksite
  • You must not reuse or duplicate SWMS documents across different projects without reviewing and updating them to reflect the specific hazards and conditions of the new project
  • Workers must genuinely review and understand documents before signing off on acknowledgements — electronic signatures must not be applied without the worker's knowledge and consent
  • Incident and corrective action records must be completed honestly and in a timely manner consistent with your legal obligations as a PCBU or employer
  • Timesheet, attendance and workforce records must accurately reflect actual work performed and attendance at site. Users must not create false, misleading or fabricated workforce records

4. Reporting Violations

If you become aware of or suspect a violation of this AUP by any user, please report it to us at support@servicesmartos.com. Include as much detail as possible, including the nature of the suspected violation and any relevant account or document identifiers.

We investigate all reports in confidence. We will not disclose the identity of the person who made the report without their consent, except where required by law.

5. Consequences of Violation

Violation of this AUP may result in one or more of the following actions, depending on the severity of the violation:

  • A formal warning issued to the account holder
  • Temporary suspension of access to specific features
  • Immediate suspension of the entire account
  • Permanent termination of the account and all associated data
  • Referral to relevant law enforcement authorities or regulatory bodies
  • Legal action to recover damages or enforce our rights

No refund will be provided where an account is terminated due to a violation of this AUP.

6. Changes to This Policy

We may update this AUP from time to time. Material changes will be notified in accordance with the notification procedure set out in the Terms of Service. Continued use of the platform after notice constitutes acceptance of the updated AUP.
